Understanding findings

A finding provides an analysis of the facts collected during the investigation. According to Sheriff's Office policies:

The standard of proof to sustain an allegation generally requires a “preponderance of evidence” (i.e., “more likely than not”) that the policy violation occurred based on the facts.

They can also use the higher standard of “clear and convincing evidence” if there is an allegation of criminal or serious misconduct. And if there is a likelihood of suspension, demotion, or termination.

Here are the dispositions imposed in a finding. It informs the type of discipline issued against an accused employee:

  • Sustained: Enough evidence supports the allegation, and it was a policy violation
  • Non-sustained: Insufficient evidence exists to prove or disprove the allegation
  • Unfounded: The allegation is not factual, or the incident did not occur as described
  • Exonerated: The alleged incident occurred but was lawful and proper
