Dependency Court

Generally, the government does not interfere in family matters. However, the law (RCW Chapter 13.34) allows the state to step in and protect a child from harm in a procedure known as a dependency action.  

A dependency action begins when a petition (a written request) is filed in Superior Court. This petition must allege that the child is "dependent."

A "dependent child has":

• Been abandoned by his or her parent, guardian, or other custodian.
• Been abused or neglected by a person legally responsible for his or her care
• No parent, guardian, or custodian capable of providing adequate care.

• Non-professional parties may participate in person, via Zoom or Zoom phone.

• Courtrooms are open and anyone may participate in or observe dependency hearings in person.

Please be patient as you wait for your hearing.  If you have a time limitation, relay that information at calendar call. Professional parties should email appearance concerns to the bailiff in advance of the calendar.

Treat the video conference hearing as if you were physically in the courtroom.  You will be visible to the court and all persons appearing on the calendar.

• Mute your microphone until asked to speak
  • If appearing by phone use *6 to mute/unmute and, if needed, use *9 to raise your hand
• Check how your name is displayed (change if it is something other than your first/last name and professional title)
• Pay attention and follow judicial officer instructions
• Be aware of what you are doing
  • Dress appropriately
  • Do not eat, smoke, change clothes, etc.
• Be aware of your background which should not be distracting
  • If in a vehicle you need to be parked
  • Remain in one place (not moving around)
• Join the calendar early and be prepared if there is a technical issue
• Notify the court in advance if there are concerns regarding privacy or restraining orders (parents or youth in a case should consult their attorney)
• Send a chat to the bailiff requesting a breakout room if a confidential conversation is needed
  • When leaving the breakout room, choose the LEAVE option (clicking LEAVE MEETING ends your connection and will require you to sign in again)

After your hearing is over you are welcome to leave the virtual courtroom.

Due to the confidential nature of dependency cases, information is not provided online.  Hearing details, including type of hearing, date, time and location is listed on court orders.  For help on getting hearing information, contact a professional party on the case (social worker, attorney or CASA) or get assistance from the Court Clerk’s Office (picture ID will be required to access confidential records).
